RATES/ PAYMENTS

Payment of full rental term is due at time of pickup/extension unless long-term payment plan has been established. There is no rate change for orders returned before the scheduled rental period end date unless 24 hours’ notice is provided. Deposits are fully refundable with 48 hours’ notice of cancellation. Cancellations with less than 48 hours’ notice are non-refundable.

CONDITION, DAMAGE, OR LOSS

Customer is responsible for any damage to item(s) sustained during the Rental Period, regardless of who caused the damage. KC Frost Wagon will make a good-faith effort to provide item(s) in the best possible condition but does not extend a warranty. Customer agrees to rent item(s) in “AS IS” condition and can make an appointment to view item(s) in person prior to rental. Customer is responsible for inspection of item(s) upon receipt and should notify KC Frost Wagon of issues or damage sustained during Rental Period, along with photos. Customer agrees to immediately discontinue use of rented item(s) should they become unsafe or in a state of disrepair and will immediately notify KC Frost Wagon of the facts. Customer may either (A) Arrange repair of damaged item and provide documentation, or (B) Request a KC Frost Wagon agent to service or replace item. A service fee of $100 will be assessed for such requests. Customer is responsible for all costs associated with damaged items, including repair/replacement parts and service costs. Items that are damaged during the Rental Period do not relieve the customer of rent charges during the Rental Period. Rented items must be returned in clean, good condition. A cleaning fee of $150 will be assessed for items that are not clean when returned.

DELIVERY AND PICKUP

Pick-ups and drop-offs must be prescheduled, and by appointment only. Please note that delivery and pickup windows are estimated and could be affected by traffic and other conditions outside of our control. Additional fees may apply if Customer is unable to receive item(s) upon delivery, or if item(s) are not ready at agreed upon pickup time.

RENTAL PERIOD

Customer is responsible for rental charges for the entire Rental Period (regardless of when we pick up). Rental Period is defined as the period of time Customer reserved through KC Frost Wagon’s website. If Customer desires to extend the rental term beyond original reservation, approval from KC Frost Wagon prior to expiration of rental term is required. If approval to extend is not obtained and A fee of $50 plus $4.75 per mile from KC Frost Wagon’s will be assessed if KC Frost Wagon repossesses the item, plus dump fees, as applicable, if item is not empty. KC Frost Wagon, including its representatives, may enter your property for the purpose of this agreement. You waive any right of action against KC Frost Wagon for such entry. In addition, you acknowledge that the failure to return rented item(s) within the contracted time and the sale or concealment of rented item(s) constitutes a crime. KC Frost Wagon may notify authorities and take other legal action, including filing a criminal complaint, subjecting you to criminal prosecution.

FUEL TOP OFF

Equipment will come with a full tank of Regular unleaded ethanol free fuel. Customer agrees to replace/refill diesel fuel used or understands additional charges will be incurred equal to market value per gallon plus a $20 service fee.

USAGE

KC Frost Wagon makes no warranties or indemnification relating to your use of the item(s). All parties renting item(s) from KC Frost Wagon represent and warrant that their use will be consistent with applicable laws including, without limitation, copyright, privacy, and publicity laws, and that they will not infringe or violate the rights of any other party. KC Frost Wagon is not responsible for any fees associated with Customer’s non compliance with city/state laws and ordinances. All rights not granted by KC Frost Wagon are specifically reserved. Subleasing and improper use is prohibited. You have read and understand all applicable manuals or operating instructions and warnings for the equipment. KC Frost Wagon shall not be responsible for any injury or damage, including consequential damage, resulting from failure or defect of rented item. KC Frost Wagon is not responsible for any content stored in the cooling trailer due to natural causes, failures caused by tripped breakers, or insufficient power.
